In addition to causes of action under the California lemon law, this lawsuit also includes causes of action for violating California's Consumers Legal Remedies Act, unfair competition, negligent misrepresentation, and intentional misrepresentation.
California Lemon Law Allegations Against Paul Blanco
The plaintiff’s complaint against EZ Auto Solutions (hereafter “Paul Blanco”) in this case alleges that Paul Blanco violated the California lemon law by selling her a used 2008 Dodge Avenger that became inoperable and unsafe to drive within a week after she bought it from Paul Blanco. In particular, she alleges that Paul Blanco sold her a vehicle that surges ahead uncontrollably and unpredictably stalls. She further alleges that these defects, which Paul Blanco was either unwilling or unable to repair, amount to violations of the California lemon law’s implied warranty of merchantability.
Undisclosed Rental History and Accident Damage Allegations Against Paul Blanco
The California lemon law attorney representing plaintiff Olivia Miller in this case has also alleged that Paul Blanco tricked plaintiff Olivia Miller into buying a used vehicle that was previously registered as a rental vehicle and which was had also sustained substantial accident damage. The California lemon lawyer’s complaint goes on to allege Paul Blanco has an illegal business practice of selling vehicles to California consumers without disclosing known rental histories and/or accident damage, and seeks an injunction preventing Paul Blanco from engaging in such conduct in the future.
Please note: the Sacramento County Superior Court has not yet ruled that Paul Blanco or EZ Auto Solutions violated the California lemon law or any other applicable laws. As is the case in most lawsuits, the defendant is expected to deny all liability and wrongdoing.
